It has already been stated that for a contract to be validly concluded, all legal prerequisites must be met (capacity of the parties, consent, correct form, permissible subject matter, and legal basis). If one or more of these prerequisites were not fulfilled at the time of concluding the contract, the contract is invalid.

  • Voidability (relative invalidity)
